Welcome to ByteFlavor. These Terms of Service ("Terms") govern your use of the ByteFlavor website, application, and services (collectively, the "Service"), operated by ByteFlavorAI ("ByteFlavor," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What ByteFlavor Is — and Is Not
ByteFlavor is a cooking and nutrition companion that helps you discover recipes, plan meals, and track nutrition based on targets you set or that are computed from information you provide.
ByteFlavor is not a medical service. The Service does not provide medical advice, diagnosis, or treatment. Nutritional targets, meal suggestions, recipes, and any other content provided by the Service are for informational and educational purposes only. They are not a substitute for professional medical advice from a physician, registered dietitian, or other qualified healthcare provider.
If you have a medical condition, including but not limited to diabetes, always consult your healthcare provider before making changes to your diet, and follow their guidance over anything suggested by the Service. Never disregard or delay seeking professional medical advice because of something you read or received on ByteFlavor. If you experience a medical emergency, call your local emergency number immediately.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and capable of entering into a binding agreement.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when creating your account and to keep it up to date. Notify us promptly at [email protected] if you suspect unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.
4. Health Information You Provide
To personalize your experience, you may choose to provide information about your body, health goals, dietary restrictions, and health conditions. You are not required to provide this information, but some features depend on it. Our collection and use of this information is described in our Privacy Policy. You represent that any information you provide is accurate to the best of your knowledge; the quality of the Service's suggestions depends on the accuracy of your inputs.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Attempt to access other users' accounts or data;
- Interfere with, disrupt, or place undue load on the Service or its infrastructure;
- Reverse engineer, scrape, or copy the Service or its content except as permitted by law;
- Use automated systems to access the Service without our written permission;
- Misrepresent your identity or affiliation.
6. Content and Intellectual Property
The Service and its content — including software, design, text, graphics, logos, and the recipes and meal plans generated by the Service — are owned by ByteFlavor or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.
Content you submit to the Service (such as saved preferences, notes, or feedback) remains yours. By submitting it, you grant us a worldwide, royalty-free license to use it as needed to operate, improve, and provide the Service.
7. Beta Features and Changes to the Service
The Service, or parts of it, may be offered as a beta or early-access release. Beta features may contain errors, may change or be removed without notice, and are provided without any commitment regarding reliability or availability. We may modify, suspend, or discontinue any part of the Service at any time.
8. Third-Party Services
The Service may link to or rely on third-party services and data sources (for example, nutrition databases). We are not responsible for third-party content or services, and your use of them may be subject to their own terms.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT NUTRITIONAL INFORMATION WILL BE COMPLETE OR ACCURATE. NUTRITIONAL VALUES ARE ESTIMATES BASED ON AVAILABLE DATA AND MAY VARY FROM ACTUAL VALUES.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BYTEFLAVOR AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS ($50).
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless ByteFlavor from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 6, 9, 10, 11, and 14) will survive.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you (for example, by email or an in-app notice) before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Alameda County, California, and you consent to their jurisdiction.

This Privacy Policy explains how ByteFlavorAI ("ByteFlavor," "we," "us") collects, uses, and protects your information when you use the ByteFlavor website, application, and services (the "Service").
We built ByteFlavor to help you eat well, and that requires your trust. This policy is written to be read, not just scrolled past.
1. Information We Collect
Account information. Your email address and password (stored in hashed form) when you create an account.
Health and profile information you choose to provide. To personalize nutritional targets and meal suggestions, you may provide information such as your age, sex, height, weight, activity level, health goals, dietary restrictions and preferences, and health conditions (for example, diabetes-related information). Providing this information is optional, but some features depend on it.
Usage information. How you interact with the Service — pages viewed, features used, recipes saved, plates created, and similar activity — along with technical data such as device type, browser, IP address, and approximate location derived from it.
Conversations with our assistant. If you use ByteFlavor's conversational assistant, we collect the messages you send and the responses you receive. These conversations may include health-related details you choose to share; they are treated as health information under Section 4. We use conversations to provide the assistant's responses, maintain your conversation history, and improve the assistant's quality. If we use a third-party AI provider to power the assistant, your messages are processed by that provider as a service provider on our behalf, under contractual confidentiality obligations, and are not used by us to train third-party models without your consent. We do not send your account information (such as your email address) to the AI provider; only the content of your messages is shared as needed to generate responses.
Communications. If you contact us, participate in an interview or survey, or respond to our messages, we keep those communications.
Cookies and similar technologies. We use cookies and similar technologies to keep you signed in, remember preferences, and understand how the Service is used. You can control cookies through your browser settings; disabling some may affect functionality.
2. How We Use Your Information
We use your information to:
- Provide and personalize the Service, including computing your nutritional targets and generating meal suggestions;
- Maintain and secure your account;
- Improve the Service, including analyzing usage patterns, diagnosing problems, and developing new features;
- Communicate with you about the Service, including updates, security notices, and — if you opt in — product news;
- Comply with legal obligations and enforce our Terms of Service.
We do not sell your personal information. We do not share your health information with advertisers.
3. How We Share Information
We share information only in these circumstances:
Service providers. We use third-party providers to operate the Service (for example, cloud hosting and email delivery). They may process your information only on our behalf and under contractual confidentiality obligations.
Advertising and analytics for non-health data. If we use advertising platforms (for example, to measure the effectiveness of our ads), we share only limited, non-health technical data as needed for that purpose. We do not share your health or profile information with these platforms.
Legal requirements. We may disclose information if required by law, subpoena, or legal process, or to protect the rights, safety, or property of ByteFlavor, our users, or others.
Business transfers. If ByteFlavor is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any change in ownership or use of your personal information.
Aggregated or de-identified data. We may use and share data that cannot reasonably identify you (for example, aggregate statistics about how meals are planned) for research, analytics, and product improvement.
4. Health Information
We treat the health-related information you provide with heightened care. It is used solely to deliver and improve the Service's personalization features. It is not used for advertising, not sold, and not shared with third parties except service providers who process it on our behalf as described above.
ByteFlavor is a consumer wellness product and is not a healthcare provider; we are not subject to HIPAA. This policy, and applicable consumer privacy laws, govern how your information is handled.
5. Data Retention
We keep your information for as long as your account is active or as needed to provide the Service. If you delete your account, we delete or de-identify your personal information within 90 days, except where we must retain it to comply with legal obligations, resolve disputes, or enforce agreements. Backup copies may persist for a limited additional period before being purged on a rolling basis.
6. Your Rights and Choices
Depending on where you live, you may have rights to:
- Access the personal information we hold about you;
- Correct inaccurate information;
- Delete your personal information;
- Export your data in a portable format;
- Opt out of marketing communications (every marketing email includes an unsubscribe link).
You can exercise these rights by contacting us at [email protected] or through your account settings where available. We will verify your request and respond within the timeframe required by applicable law. We will not discriminate against you for exercising these rights.
California residents. Under the California Consumer Privacy Act (CCPA/CPRA), you have the rights listed above, plus the right to know the categories of information we collect and the purposes for which we use them (described in Sections 1–3). We do not sell or share personal information as those terms are defined under the CCPA.
7. Security
We use reasonable technical and organizational measures to protect your information, including encryption in transit, hashed passwords, and access controls. No system is perfectly secure; if we learn of a breach affecting your personal information, we will notify you as required by law.
8. Children

9. International Users
The Service is operated from the United States. If you use the Service from outside the U.S., your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.
